Open Calls Arlo's Art Therapy Rules

These are the terms and conditions and rules (“Rules”) which apply to the OPEN CALLS ‘ARLO’S ART THERAPY’ (the “Experience”) organized and run by DAZED MEDIA (sponsored by CONVERSE).

If you wish to take part in the Experience, please read the Rules below carefully. You must agree to these Rules to register and participate in the Experience. DAZED MEDIA decisions are final and binding in all matters related to the Experience. Each Participant is only permitted to enter the Experience once and only by invitation from DAZED MEDIA.

OVERVIEW

WHAT IS THE EXPERIENCE?

The Experience is part of DAZED MEDIA x CONVERSE’s ongoing ‘Open to Change’ campaign/partnership. It is an opportunity to participate in a creative competition, in which three (3) of the submitted creative designs will be chosen by DAZED MEDIA, CONVERSE and Arlo Parks as the winners of the Experience and up to twenty-five (25) additional designs chosen as the second place winners.  

The three (3) winning designs will be commissioned to be shown to the public by being part of the digital campaigns of DAZED MEDIA and CONVERSE, by being printed as flyposters, that will launch between the 3rd and the 9th of November and be live for a maximum of 4 week in selected areas accompanying the tour stops in London, Manchester & Bristol. The top three (3) winning designs and up to twenty-five (25) additional designs will be incorporated in a printed journal in partnership with Arlo Parks and charity C.A.L.M. (a mental health organization for the prevention of suicide) sold through Arlo Park’s merchandising website with all proceeds going to C.A.L.M.

WHO IS ELIGIBLE FOR THE EXPERIENCE?

The Experience is open to up to any visual and/or creative artist, whose output can be printed, and who are over 18 years old at the time of entry (the “Participant”).

WHEN CAN I ENTER THE EXPERIENCE?

From 05/10/2021 at 14:00 GMT to 18/10/2021 at 23:59 GMT (“Entry Period”)

HOW DO I ENTER THE EXPERIENCE?

During the Entry Period, you must:

  1. Fill out and submit the Submission form here https://www.dazeddigital.com/art-photography/article/54363/1/heres-how-to-get-involved-in-arlos-art-therapy confirming that you agree to these Rules.
  2. Upload your creative output and your message explaining the significance of your selected artwork per the calling for artist video by Arlo Parks onto the Dropbox link provided automatically to you after completing the submission form (for example a poster design, a photograph or a still image of your creative submission that can be printed) (the “Submission”).

ENTRY REQUIREMENTS FOR THE EXPERIENCE

The Submission must be original, authentic and created by the Participant. It must not contain:

  • material that violates or infringes a third party’s rights, including privacy, publicity or intellectual property rights; 
  • material that promotes bigotry, racism, hatred or harm against any group or individual or promotes any kind of discrimination; 
  • material that violates or is contrary to the applicable law;
  • any person other than the Participant (unless agreed otherwise in writing with DAZED MEDIA);
  • anything that could cause offence including: nudity or pornographic content; acts of violence, acts that appear to cause injury or harm (including dangerous stunts); weapons of any kind, including guns, knives or projectiles, whether real, replica or toy;
  • drug use or smoking.

HOW WILL THE WINNERS BE SELECTED?

From the 15/10/2020 to the 18/10/2021 (the “Winners Selection Date”), a minimum of 3 of the Participants will be selected by DAZED MEDIA, CONVERSE and singer Arlo Parks (“ARLO PARKS”) as the winners based on the skill, originality and creativity of their Submission from among those who have entered the Experience in line with the Rules (the “Top 3 Winners”). DAZED MEDIA, CONVERSE, and ARLO PARKS may also select but are not required to select a maximum of twenty-five (25) additional participants based on the above same criteria for the Top 3 Winners (the “Second Place Winners”, together the “Winners”).

Top 3 Winners will be notified within 48 hours of the Winner Selection Date via email with instructions on how to claim the Reward.  The Second Place Winners will be notified within one (1) month of the Winner Selection Date via email with instructions on how to claim the Reward.  Winners must respond within 48 hours accepting the Reward or another Winner will be chosen.

If any selected Winners cannot verify their eligibility or has broken any of the Rules, DAZED MEDIA, CONVERSE and ARLO PARKS may choose another Winner in their place.

WHAT WILL THE WINNER OF THE EXPERIENCE RECEIVE?

Each of the Top 3 Winners will receive:

  • the opportunity to be commissioned by DAZED MEDIA in relation to the design submitted by the Winner
  • to be part of the flyposting campaign in campaign that will launch between the 3rd and the 9th of November and be live for a maximum of 4 week in selected areas accompanying the tour stops in London, Manchester & Bristol.
  • To be part of the printed journal in partnership with CONVERSE, ARLO PARKS and charity C.A.L.M. (the “Printed Journal”) to be sold through ARLO PARKS with all proceeds going to charity C.A.L.M.
  • To potentially receive Editorial Special & Socials Coverage via DAZED MEDIA, CONVERSE and ARLO PARKS.

Each Top 3 Winner will receive a fee of £ 500.00 (GBP) for their work (the “Top 3 Winners Reward”). This fee will be paid by DAZED.

Each of the Second Place Winners will receive:

  • the opportunity to be featured by DAZED in the Printed Journal and
  • potentially receive Editorial Special & Socials Coverage via DAZED MEDIA, CONVERSE and ARLO PARKS 

Each Second Place Winner will receive a fee of £100.00 (GBP) for their work (the “Second Place Winners Reward”) subject that they accept the same Conditions set out below.

The Winner’s receipt of the Reward is conditional on:

  • The Winners granting a royalty free, non-exclusive and irrevocable license to CONVERSE, DAZED and ARLO PARKS to use the Winner’s rights, title and interest in the Winners designs included in their Submission, including all associated intellectual property rights and exploitation rights, for a period of 12 months from the Winner Selection Date (together the “Conditions”). 

If a Winner does not agree to the Conditions set out above, then the Winner acknowledges that he or she shall not be entitled to the Top 3 Winners Reward or Second Place Winners Reward (together the “Reward”) and that DAZED, CONVERSE and Arlo Parks may award the Reward to another Participant. 

The Winner is responsible for any and all other costs and expenses not listed above. The Winner’s participation in any or all activities for the Reward is voluntary. If the Winner elects not to participate in any or all designated activities for the Reward, the Winner will not be afforded any compensation.

CONDITIONS OF THE EXPERIENCE

  • Waddell Ltd (registered company number 03039139) located at 2nd Floor, 2 Arundel Street, London WC2R 3DA (t/a Dazed Media) (“DAZED MEDIA”) is solely responsible for the Experience which includes, without limitation, being responsible for all of the Participants’ Submissions and any other services or obligations that the Participants may need to perform throughout the Experience. 

  • Only one Submission per person for the Experience is permitted. DAZED MEDIA reserves the right to suspend, cancel or amend the Experience and/or any of these Rules without prior notice if it cannot be operated, conducted or completed as planned and/or due to events or circumstances arising beyond DAZED MEDIA’s control, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of the Experience. DAZED MEDIA will always endeavour to minimise the effect to Participants in order to avoid disappointment. Participants may be required to: (a) provide identification; (b) sign a declaration and release; and/or (c) sign an image release form, in order to claim the Reward and/or take part in the Experience.  

  • Participants who do not give correct details, make an entry on someone else’s behalf or submit more than one Submission per person may be disqualified at DAZED MEDIA’s discretion. Entries from agents, third parties, organised group entries, bulk entries or entries automatically generated by a computer will not be accepted. DAZED MEDIA has sole discretion to determine whether a Submission is eligible. DAZED MEDIA reserves the right to disqualify a Participant where it suspects there has been a breach of these Rules, where a Participant has gained unfair advantage or used fraudulent means or where a Participant might, in the reasonable opinion of DAZED MEDIA, bring the DAZED MEDIA (and/or CONVERSE) brands into disrepute.

  • From the start of the Entry Period until 12 months from completion of the Experience (the “Usage Period”) the Participant grants a worldwide, non-exclusive, royalty free and irrevocable licence to DAZED MEDIA and CONVERSE to use all of its right, title and interest in its Submission, including all associated intellectual property rights and exploitation rights, in any media for the purposes of performing the Experience and any related activities (including, without limitation, promoting, advertising and marketing the Experience) (the “Purpose”). In addition, DAZED MEDIA and CONVERSE may, during the Usage Period, use the Submission with or without using the Participant’s name, in any media throughout the world, for the Purpose. By making a Submission and taking part in the Experience, Participant agrees not to instigate, support, maintain, or authorise any action, claim, or lawsuit against DAZED MEDIA and/or CONVERSE, or any other person, on the grounds that any use of the Submission, or any derivative works, infringe any of the Participant’s rights, including, without limitation, copyrights and moral rights and each Participant agrees to waive its moral rights (or similar rights). Each Participant further acknowledges that DAZED MEDIA and/or CONVERSE is in no way obligated to publish or use the Submission in any way.  

  • Participant agrees that DAZED MEDIA and CONVERSE may photograph and/or film the Participant during their attendance at and/or participation in the Experience (“Recording”) and may use their image. During the Usage Period, Participant grants DAZED MEDIA and CONVERSE the right to use, throughout the world and without any compensation, any Recording of them in any media for the Purpose. Participant also grants DAZED MEDIA and CONVERSE permission to display their name, image, Experience standings and results during the Experience for the Purpose.  Participant grants DAZED MEDIA and CONVERSE a right to use all comments, feedback and ideas that Participant shares with them during the Experience without notice, compensation or acknowledgement to Participant.

  • CONVERSE status with respect to the Experience is solely that of a sponsor with a right to exploit its sponsorship rights of the Experience (which includes a right to contribute to the selection of the Winner) and accordingly CONVERSE does not accept responsibility for any postponement, delay, or cancellation of the Experience or any removal of or rejection of a Participant from the Experience. To the maximum extent permitted under applicable law, CONVERSE shall not be liable to a Participant for any loss, damage, injury or disappointment suffered by any Participant resulting from entering into or taking part in the Experience (including, without limitation, that may arise from any selection of a Winner or the award or withdrawal of a Reward). In these Rules, references to CONVERSE includes any member of the “CONVERSE Group” which means CONVERSE NETHERLANDS B.V, its subsidiaries, its parent company and any subsidiaries of its parent company.

  • Any award of the Reward is conditional on the Winner complying with the Conditions set out in the Overview. Any Reward details that are not specified will be determined by CONVERSE and DAZED in their sole discretion. The Reward is not transferable and must be accepted as awarded. No substitution of the Reward may be made, except by CONVERSE, who reserves the right to substitute the Reward with another prize of equal or greater value if the Reward is not available for any reason. Rewards will be reported as income to a Winner and the Winner is responsible for taxes, if any, associated with the receipt of the Reward. To the maximum extent permitted under applicable law, CONVERSE do not accept responsibility for any loss, changes to, postponement of, or unavailability of the Reward to the Winner.

  • These Rules constitute the entire agreement between the parties and supersedes and extinguishes all previous drafts, agreements, arrangements and understandings between them, whether written or oral, relating to its subject matter. These Rules cannot be altered or modified except by DAZED MEDIA in accordance with the Rules. Each party agrees that it shall have no remedies in respect of any representation or warranty (whether made innocently or negligently) that is not set out in the Rules.

  • If any provision in these Rules is held, in whole or part, to be invalid or unenforceable for any reason, the validity of the remaining provisions of these Rules shall not be affected, and they shall continue to be valid and enforceable. The invalid or unenforceable provision shall be replaced with a valid provision which is as similar as possible in substance to the invalid or unenforceable provision. 

  • These Rules and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the jurisdiction of the Participant’s residence. If, however, the Participant is not acting in their capacity as a consumer, then these Rules and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and the courts of England and Wales shall have exclusive jurisdiction in respect thereof. 

DATA PROTECTION NOTICE

For the purposes of these Rules, the data controller is DAZED MEDIA. In taking part in the Experience, you will provide DAZED MEDIA with certain personal data, such as contact details, personal details associated with the Experience and images. More information about how DAZED MEDIA processes your personal data can be found at DAZED MEDIA’s Privacy Policy, which is available at Privacy Policy | Dazed (dazeddigital.com) .

You understand and acknowledge that by registering for the Experience and ticking the box to state that you agree with this Data Protection Notice, you give consent for DAZED MEDIA to process your personal data and for DAZED MEDIA to share your personal data with CONVERSE. You can withdraw your consent at any time. If you do this, DAZED MEDIA and CONVERSE will no longer be able to process your personal data and as a result you will no longer being able to take part in the Experience. 

CONVERSE processes the personal data to exploit its sponsorship rights of the Experience, and to handle follow up matters after the Experience (e.g. for possible job commissions). CONVERSE may share your personal data with third parties to process the data on CONVERSE’s behalf. When using third parties to process data, CONVERSE will require the third parties to implement appropriate measures to protect your personal data. CONVERSE may transfer or store the personal data collected and processed as part of the Experience outside of the EEA or Switzerland. When doing so, CONVERSE will ensure that your personal data transferred to these countries receives adequate protection in accordance with data protection rules.

CONVERSE will process your personal data at all times in accordance with applicable data protection legislation.
